Abolish contract system for support service workers in public premises

The full absorption of support service workers in public premises as full time government employee. Direct employment will guarantee these workers rights and benefits as enjoyed by other employees who were already employed directly in these premises like doctors & teachers. In case of reforms, during the procurement process; such as banning subcontracting, regulating the appointment of procurement board members. Legal reforms; removing secrecy laws, include external party as monitors. Operational reforms; such as blacklisting contractors who violates workers rights, including special clause of cancellation taking bond money from contractors as security money for workers. And most importantly, workers right reforms, as stated in the employment act, and to be adequately protected during the pandemic with vaccination priority, proper PPE and frontliners' allowance.

We demand that the government organises a department that monitors such trends and propose plans to alleviate the problems that may be faced by such community of workers like for instances retraining and reskilling these workers to enter another or new sectors of the economy.

Additionally, since large numbers of plantation workers are being displaced, there is a need to manage this movement from rural to urban areas. It's therefore imperative that these groups of people are provided training and reskilling and social skills for urban living. The government should look into allocating additional funds for these group of people to go into small businesses.

Therefore we demand that legislations be introduced so that the foreign workers are not employed at the expense of local workers. Foreign workers should be employed only in sectors where there is an acute labour shortage and should not be used to depress the wages of local workers, whose minimum living wage must be protected by law.

Secondly, to ensure that where foreign workers are employed, they must benefit from a Malaysian sense of justice and are treated on par with local workers, enjoying the same wages, union membership and social security. Their rights must be protected.

Amend the discriminative clauses in the First Schedule of the EA1955 and amend the reference of Domestic Workers in the EA1955 as "domestic servants" to "Domestic Workers".

Employer, migrant, refugee and undocumented worker’s right should be protected by law and a system.

Comprehensive system need to be implemented to record data of employers and migrant workers so that no one can run away from their responsibilities. The system can record how much expenses for first employer paid to bring in one migrant worker, let say 10k, when Migrant worker had resign or run away, the second employer need to share the expenses. Migrant worker court needs to be implemented to protect employer and worker’s rights. Malaysia employers right also need to be protected by easy and fast to apply work permit for undocumented to avoid pay more than 10k to agent with corrupted money or get summon more than 10k if caught use undocumented workers. Employer should be able to get immediate approval like apply MITI allow business letter online so that no one will want to employ undocumented worker but subjected to online medical report and system data check to no serious dispute with previous employer and no serious criminal record. All migrant workers need to pay EPF, SOCSO and income tax monthly so that they are protected and contributing to our country economy.
