Violence against LGBTIQ Children

Pernyataan masalah:

1. LBGTIQ children lack protection from discrimination and violence perpetrated against them.
2. LGBTIQ children are at risk of multiple forms of violence including death, surveillance,
correction and rehabilitation by state actors and non-state actors in educational institutions,
detention, prisons, public and private spaces.

Nilai dan Kepercayaan:

To eradicate discriminatory laws and conservative religious teachings relating to LGBTIQ persons to
mitigate the negative impact on the mental health and overal well-being of LGBTQ children in
Malaysia.

Cadangan Penyelesaian:

1. Ensure that educational institutions, prisons, detention centres, private and public spaces
are safe spaces by eradicating targeted prejudices and discrimination by students, teachers,
enforcement, judicial authorities, social workers, child protectors, families, communities and
all stakeholders.
2. Eradicate all State and school-endorsed laws, policies and programmes targeting LGBTIQ and
gender non-conforming children on the basis of their actual or perceived sexual orientation
and gender identity.
3. Create awareness and capacitate parents, families, communities, enforcement, judicial
authorities, social workers, child protectors, religious authorities and all stakeholders on
CRC, LGBTIQ issues, best interest principle, positive parenting, referral pathways and
effective communication with children to address discrimination and violence against
LGBTIQ children.
4. Promote inclusivity of the rights of LGBTIQ persons in all national child protection laws and
policies.

of Kuala Lumpur Education Department including homosexuality and ‘gender confusion’ as a

Terjemahan

Isu dan Polisi Semasa:

Kanak-kanak LBGTQIA+ kekurangan perlindungan daripada diskriminasi dan keganasan yang dilakukan terhadap mereka.
Kanak-kanak LGBTQIA+ berisiko mengalami pelbagai bentuk keganasan termasuk kematian, pengawasan, pembetulan dan pemulihan oleh pelaku negeri dan pelakon bukan negeri dalam bidang pendidikan institusi, tahanan, penjara, ruang awam dan swasta.

Nilai-nilai dan Kepercayaan:

Untuk membasmi undang-undang yang diskriminatif dan ajaran agama konservatif yang berkaitan dengan LGBTQIA+ orang untuk mengurangkan kesan negatif terhadap kesihatan mental dan kesejahteraan keseluruhan Kanak-kanak LGBTQA+ di Malaysia.

Penyelesaian:

Memastikan institusi pendidikan, penjara, pusat tahanan, swasta dan awam ruang adalah ruang yang selamat dengan membasmi prasangka dan diskriminasi yang disasarkan oleh pelajar, guru, penguatkuasa, pihak berkuasa kehakiman, pekerja sosial, pelindung kanak- kanak, keluarga, komuniti dan semua pihak yang berkepentingan.
Menghapuskan semua undang-undang, dasar dan program yang disokong oleh negeri dan sekolah LGBTQIA+ dan kanak-kanak yang tidak mematuhi jantina berdasarkan keadaan sebenar atau orientasi seksual dan identiti jantina yang dirasakan.
Memberi kesedaran dan memberi keupayaan kepada ibu bapa, keluarga, masyarakat, penguatkuasaan, pihak berkuasa kehakiman, pekerja sosial, pelindung kanak-kanak, pihak berkuasa agama dan semua pihak berkepentingan mengenai CRC, isu LGBTQIA+, prinsip kepentingan terbaik, keibubapaan positif, jalan rujukan dan komunikasi yang berkesan dengan kanak-kanak untuk menangani diskriminasi dan keganasan terhadap kanak-kanak LGBTQIA+.
Menggalakkan keterangkuman hak-hak LGBTQIA+ dalam semua perlindungan kanak- kanak nasional undang-undang dan polisi.
