Pernyataan Masalah / Isu:

This section, as it stands now, empowered MACC to examine someone “from day to day”. In Teoh’s case, MACC officers had obviously abused this section by detaining and interrogating him from 6pm to 5am, this is an apparent a mental torture and in violation of human rights.

No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. (Article 5 of Universal Declaration of Human Rights 1948)

Cadangan Penyelesaian dan Seruan Tindakan:

Amend section 30(3)(a) of Malaysia Anti-Corruption Commission Act to limit unregulated interrogation time that led to the tragedy of Teoh Beng Hock. Government has the duty to ensure that MACC Act is human rights-compliant. There must be a political will from all political parties to amend section 30(3)(a) by simply amending the words “from day to day” to “from day to day and restrict to 10:00am-4:00pm”.
